TERMS AND CONDITIONS OF SALE
- Validity and scope of the terms and conditions
The terms and conditions of sale govern the rights and obligations arising between a customer of Repechage online shop (hereafter: Purchaser) and Beauty Treasure OÜ (hereafter: Beauty Treasure OÜ) with the purchase of goods (hereafter: Product/Products).
In addition to the Terms and Conditions,
the legal relationships arising from the purchase of Products from the Beauty Treasure OÜ online shop shall be regulated by the legislation applicable in the Republic of Estonia.
Beauty Treasure OÜ reserves the right to change the Terms and Conditions of Sale and the sales prices. These changes will be made available on the Beauty Treasure OÜ’s web page www.repechagebeauty.com. By accepting these conditions, the Purchaser confirms that (s)he has read the Terms and Conditions of Sale, agrees to them and will follow them.
- Goods and price information
Information about the goods is provided at the Beauty Treasure OÜ online shop directly next to the goods.
The prices of the products sold on the Beauty Treasure OÜ online shop are indicated in euros and include VAT at 20%.
The price is subject to a delivery charge. The delivery charge depends on the location of the buyer and the delivery method. The delivery charge will be displayed to the buyer when placing the order.
- Placing an order
On the website, you can order Products that have „Add to shopping cart“ icon next to them. To order the desired Product, just add it to your shopping cart.
Products intended for professional use can be ordered only by business customers employed in the beauty-service industry, confirmed by Beauty Treasure OÜ.
The Purchaser can check the items in his/her shopping cart by clicking on the „Cart“ icon at the top of the webpage. The number of Products in a shopping cart can be changed by writing the desired number in the appropriate field. The Products can be deleted by clicking on the cross located on the same line with the Product.
Before completing the order, choose the most suitable delivery method. The delivery is free for all Estonian orders over € 150.
To complete the order, click „Proceed to checkout“. To confirm your order, click „Order and pay“.
Next, an invoice will be generated and you can proceed with a payment using your credit card, online banking link or bank transfer.
The confirmation of the order (i. e. proforma invoice) will be sent to the Purchaser’s email address. Beauty Treasure OÜ will dispatch Products only after the receipt of the payment. If the ordered goods cannot be delivered due to expiry of the delivery period or for any other reason,
the buyer will be informed as soon as possible and the money paid (including delivery costs) will be refunded immediately,
but not later than 14 days after the notification.
The Buyer undertakes to pay for the order once the “Place order” button has been pressed.
The contract of sale will enter into force as from the date of receipt of the amount due into the bank account of Beauty Treasure OÜ.
Goods are sent to Estonia, Latvia, Lithuania and Finland.
The shipping costs are paid by the buyer and the corresponding price information is displayed with the shipping method.
Shipments within Estonia generally arrive at the destination specified by the buyer within 3 working days from the entry into force of the sales contract. Outside Estonia, delivery will take place within 7 calendar days. In case of delay for any reason, Beauty Treasure OÜ representative will inform the buyer.
Beauty Treasure OÜ shall not be held responsible for a delay in delivery,
if the goods were handed over to logistics partners on time, but the delivery was delayed due to circumstances that Beauty Treasure OÜ could not foresee or control.
- Right of withdrawal
After receiving the Products from the Beauty Treasure OÜ online shop, the Purchaser has the right to withdraw from the contract entered into with the online shop within 14 days.
Please note that, in accordance with the instructions of the Consumer Protection Board, the right of return does not apply to products that cannot be returned for hygiene reasons (such as cosmetics). Therefore, the products to be returned must be unused and the packaging must be intact and undamaged.
In order to return the goods, please contact Beauty Treasure OÜ customer service by e-mail and send a cancellation to firstname.lastname@example.org within 14 days of receipt of the goods.
The purchaser must return the goods within 14 days of submitting the request or provide proof that he/she has handed over the goods to the carrier within the aforementioned period.
The cost of returning the goods shall be borne by the purchaser, unless the reason for returning the goods is that they do not correspond to the order (e.g. the goods are incorrect or defective).
In the event of return of the goods, the purchaser shall be reimbursed the cost of the goods to be returned, plus delivery charges, within a maximum of 14 days from the date of receipt of the request to return the goods.
Beauty Treasure OÜ may refuse to refund until it has received the item that is the subject of the sales contract or until the buyer has provided proof that it has returned the item, whichever is the earlier.
If the purchaser has expressly chosen a delivery method other than the cheapest delivery method offered by Beauty Treasure OÜ, Beauty Treasure OÜ is not obliged to reimburse the consumer for the cost exceeding the cost of the usual delivery method.
The right of withdrawal does not apply if the buyer is a legal entity.
If it turns out that the Buyer has not received the product ordered, the goods do not correspond to the description in the e-shop or the product is defective, the Buyer does not have to make a withdrawal within 14 days, but may exercise the statutory right of complaint.
- Liability and Complaints procedure
Beauty Treasure OÜ shall be liable for the non-compliance of the Product sold to the Purchaser with the terms and conditions of the contract or for defects which existed at the time of its handover to the Purchaser and which occur within two years of the handover of the Product to the Purchaser. Within the first six months as of its handover to the Purchaser, it is assumed that the defect was present upon handover of the Product. It is Beauty Treasure OÜ’s responsibility to prove otherwise.
The Purchaser has the right to submit complaints with T Beauty Treasure OÜ with regard to a non-comforming Product within the period of two months from the date of its handover to the Purchaser.A complaint has to be submitted my sending and e-mail to email@example.com
The claim must state:
1) The name and contact details of the buyer;
2) The date of the complaint;
3) The shortage of goods;
4) Claim for the online shop;
5) Reference to or attach a copy of the document proving the transaction to the complaint.
Beauty Treasure OÜ will respond to the complaint in writing within 15 days after the receipt of the complaint from the Purchaser. If Beauty Treasure OÜ is unable to provide a response to the Purchaser’s complaint within 15 days, Beauty Treasure OÜ will inform the Purchaser of that in writing, stating the reason for delay and the date by which the response will be provided.
Beauty Treasure OÜ is not liable for any defects that have occurred after the delivery of the goods to the buyer.
In the event that the goods purchased by Beauty Treasure OÜ have defects for which the online shop is liable, Beauty Treasure OÜ will replace the defective goods. In the event that the goods cannot be replaced, the online shop will reimburse the purchaser for the fees paid under the sales contract.
- Data processing and security
Any personal data that the Purchaser/Customer provides while visiting and shopping in Beauty Treasure OÜ online shop are considered confidential information. Except for cases when a courier requires the Purchaser’s/Customer’s name, phone number or delivery address for goods delivery purposes, or in other cases prescribed by law.
Beauty Treasure OÜ sends newsletters and offers to the purchaser’s e-mail address only if the purchaser has expressed his/her wish to receive them by entering his/her e-mail address on the website and has indicated his/her wish to receive direct mail notifications.
The purchaser may opt-out of receiving offers and newsletters by e-mail at any time by notifying us by e-mail or by following the instructions in the e-mail containing the offers.
- Dispute settlement
If the purchaser has any complaints regarding Beauty Treasure OÜ, they should be sent by e-mail to firstname.lastname@example.org.
If the purchaser and Beauty Treasure Ltd are unable to resolve the dispute by agreement, the purchaser may refer the matter to the Consumer Disputes Committee. The terms and conditions of the procedure can be consulted and the application can be submitted at www.komisjon.ee . The Consumer Disputes Committee is competent to settle disputes arising out of a contract concluded between the buyer and the Online Shop. The examination of the buyer’s complaint by the Commission is free of charge.
